This is a convenience translation of the German AGB. Only the German version is legally binding.
§1 Scope, provider
(1) These terms apply to all contracts for the use of the "Gravel" service (the "Service") between Victor Gulchenko, Emanuelstraße 27, 80796 München, Germany ("we"), and you as a user ("you").
(2) The Service is for consumers within the meaning of §13 BGB. We do not accept differing terms unless we expressly agree to them.
(3) The contract language is German. This English translation is for information only. The German version prevails.
§2 Definitions
| Term | Meaning |
|---|---|
| Channel | how Gravel communicates with you: WhatsApp, Telegram, Threema or SMS; iMessage later |
| Source | a mailbox, calendar or document that you connect to Gravel or send to it |
| Action | anything Gravel does for you, for example sending an email, creating an event, cancelling a contract, submitting a form on a website |
| Autonomy level | your setting for how independently Gravel may carry out a kind of action (§6) |
| Confirmation | your approval of a specific action shown to you |
| Automation | a routine you create that runs on a schedule or an event (§8) |
| Browser task | an action Gravel carries out on a website in an isolated browser (§7) |
§3 Conclusion of contract, minimum age, account
(1) Minimum age. You must be at least 18 years old and confirm this when you sign up. We may suspend the account if we have reasonable grounds to believe this is not met.
(2) Conclusion of contract.
- The contract for the free plan is concluded when you complete sign-up (linking a channel and accepting these terms) and we activate access.
- The contract for a paid plan is concluded when you press the "order with obligation to pay" button and we confirm the order.
- Before you submit the order, you can review and correct your entries in the summary.
(3) Contract text. We store the contract text and send you these terms and the contract details in text form after conclusion. The current version is at gravel.chat/terms.
(4) Account. One account per person. You may connect only sources you are entitled to use, in particular your own mailboxes, calendars and accounts.
§4 Services
(1) Gravel is a personal assistant based on artificial intelligence. Depending on the plan, Gravel can:
a) read: read connected mailboxes and calendars, and analyse documents you send;
b) speak first: tell you proactively about things that need your attention, such as deadlines, delays, price increases, official letters or urgent messages;
c) answer and remember: answer questions, remember things and write drafts;
d) act: carry out actions within your autonomy levels (§6), including browser tasks (§7) and automations (§8);
e) talk: exchange voice messages with you (§9).
(2) The scope of each plan is described at gravel.chat/pricing at the time of order.
(3) Gravel works with probabilities. It can miss things, classify them wrongly or summarise them wrongly. Statutory deadlines are computed with fixed rules. Whether a deadline actually runs in a given case can depend on facts Gravel does not always know, such as the actual delivery date. Gravel points out such assumptions.
§5 What Gravel is not
(1) Gravel provides no legal advice, no tax advice and no financial or investment advice. Explanations of letters, deadlines, contracts or statements are general information and help for self-help. They do not replace advice from a lawyer or a tax adviser. Where a lot is at stake, for example a court payment order, a fine notice or large amounts, Gravel recommends professional help.
(2) Gravel is not a payment service. We do not receive, hold or transfer funds. By default Gravel does not make payments itself; it prepares them and hands them off to you (§6(3)).
(3) Gravel does not call third parties and never pretends to be human towards third parties.
§6 Your control: autonomy levels, confirmation, pause
(1) You decide what Gravel may do on its own. You choose an autonomy level for each kind of action. Gravel acts only within these levels.
| Level | Meaning |
|---|---|
| "auto" | Gravel acts without asking first. |
| "on request" | Gravel acts only when you explicitly ask for exactly that action; otherwise it asks first. |
| "ask first" | Gravel proposes the action and carries it out only after you confirm. |
| "hand off" | Gravel never carries out the action itself; it prepares it and shows you how to do it yourself. |
(2) Confirmation. Your confirmation covers only the specific action Gravel showed you: recipients, content, amount. If anything changes, a new confirmation is needed. You can confirm only from a channel linked to your account. A proposal expires after 24 hours.
(3) Defaults and floors.
- Out of the box, the levels are conservative: actions that reach other people or cost money are "ask first"; payments and purchases are "hand off".
- Payments, purchases, cancellations, forwarding, deletions, messages to third parties and deleting your account always require at least "ask first". You cannot set them to "auto".
- Gravel sends messages to third parties in your name only after you approved that exact text.
(4) Risk check. Before every action, Gravel runs a fixed risk check that the AI does not control. It can only make the level stricter, never looser. Gravel therefore asks even at "auto" when, for example:
- money is involved
- a recipient is new, or was named only in someone else's message
- many items are affected
- an unfamiliar website is involved
Gravel refuses patterns that indicate data theft, such as mass forwarding to unknown recipients.
(5) Spending caps. You set a cap per action and per month. Above the per-action cap, Gravel always asks. It does not carry out actions that would exceed the monthly cap.
(6) Pause. "Pause" (also for a limited time) stops all scheduled and background work: proactive messages, automations, monitors and goals. Gravel still answers your own direct requests.
(7) Declarations to third parties. When Gravel carries out an action that contains a declaration to a third party (for example a cancellation or an email), it transmits your declaration with the content you approved or that your autonomy level covers. It is your declaration. You are responsible for checking approved content before you confirm it.
(8) Transparency. The activity log shows everything Gravel read and did ("what did you look at today?").
§7 Browser tasks and third-party websites
(1) For tasks that can only be done on a website, Gravel uses a short-lived, isolated browser on servers in the EU. You can take over a running browser task live at any time and hand it back. Browser tasks are being introduced step by step. Where a task cannot yet be done this way, Gravel prepares it and hands it to you.
(2) Credentials.
- You store website credentials in your personal vault. Gravel uses them only for the task at hand and never shows them to the AI model.
- Store credentials only for your own accounts.
- Check yourself whether the website's terms allow the use of an assistant.
(3) Conduct towards websites.
- Gravel identifies itself to websites as an automated agent where technically supported.
- It respects site terms and robots rules.
- It does not solve CAPTCHAs or circumvent access controls. In those cases, and where terms forbid automation, it hands over to you.
(4) The operators of third-party websites are responsible for their content, availability and terms.
§8 Automations and templates
(1) You can create automations that run on a schedule or on an event. Automations act only within your autonomy levels, never write to recipients you have not dealt with, and stop when you pause.
(2) When you share an automation as a template, we remove personal data before publication. You grant us and other users a simple, free right to use the template within the Service. You can withdraw a shared template at any time.
§9 Voice messages
(1) You can send Gravel voice messages, and Gravel can answer with voice messages. Speech is processed on infrastructure in the EU. By default no audio is recorded. Transcripts are treated like chat messages. Gravel does not offer voice calls.
(2) Gravel does not phone you or third parties. A spoken confirmation in a voice message is not enough for payments, purchases, cancellations, forwarding or account deletion; those are confirmed by button or text message.
§10 AI disclosure and messages to third parties
(1) Gravel is an AI and says so at first contact, when asked, and whenever it matters.
(2) Messages Gravel sends to third parties in your name include, by default, a short note that they were written with AI assistance, and a machine-readable marker. You approve the text beforehand. Details are in our AI transparency statement.
§11 Your obligations
(1) You agree:
- to use the Service lawfully
- in particular, not to send messages that infringe the rights of others, harass or deceive
- to protect your channels (for example your WhatsApp or Telegram account) and your device appropriately
- to tell us at once if you suspect that someone else has access to a linked channel
(2) You check proposals before confirming them, and you check Gravel's results to a reasonable extent before relying on them, especially deadlines, amounts and recipients.
(3) In case of a serious breach of these obligations we may temporarily suspend your account. We take your legitimate interests into account and inform you without delay.
§12 Plans, prices, payment
(1) We offer a free plan and a paid plan. The free plan is limited (§13). The prices shown at the time of order apply, including statutory VAT. The paid plan currently costs €12 per month.
(2) Payment is processed by our payment service provider Mollie B.V. via SEPA direct debit or card. The fee is due at the start of each billing period. For SEPA direct debit we tell you the amount and date at least one day in advance (pre-notification).
(3) Costs you incur through your channel (for example mobile charges) are governed by your contract with that provider. Costs we incur for messages (for example WhatsApp templates) are not charged to you separately.
(4) Price changes for running contracts take effect only with your express consent. If you do not consent, the contract continues at the previous price. We may then terminate it with ordinary notice under §14(4).
§13 Free plan
(1) Limits. The free plan is limited, for example to a number of days after sign-up or to a certain scope of use. The limits that apply to you are shown before you sign up and at gravel.chat/pricing.
(2) No automatic switch to a paid plan. When a limit is reached, the features concerned pause until you order the paid plan. The free plan never turns into a paid contract by itself; a paid contract requires your order (§3(2)).
(3) Your data. Your data stays when a limit is reached. You can export or delete it at any time (§14(6)).
(4) Preview features. We may offer individual features as a preview. Preview features may change, be limited or be removed, and are marked as such. Your rights under §§327 ff. BGB are unaffected.
§14 Term, termination, cancellation button
(1) Free plan. It runs indefinitely, within its limits (§13). You can end it at any time without notice, for example with "delete my account". We can end it with one month's notice.
(2) Paid plan. The paid plan runs for one month and then continues indefinitely. You can cancel at any time with one month's notice, to the end of the current billing month.
(3) How to cancel. You can cancel:
-
by message to Gravel ("cancel my subscription"), by email to victor.gulchenko@gmail.com, or in text form to our address;
-
via the "cancel contracts here" ("Verträge hier kündigen") button on our website (§312k BGB). It is permanently available, directly and easily accessible, and leads to a confirmation page. There you enter:
- the type of termination (ordinary or extraordinary, with the reason for an extraordinary one)
- details that identify you
- the contract
- the desired date
- an address for the confirmation
The "cancel now" ("jetzt kündigen") button submits the cancellation. Without a date, the cancellation takes effect at the earliest possible time.
-
We confirm receipt immediately in text form, with the date and time of receipt and the date the contract ends.
(4) Our right to terminate. We can terminate the paid plan with one month's notice to the end of a billing period. Fees already paid for periods after the end are refunded pro rata.
(5) Termination for cause. The right of both parties to terminate for good cause (§314 BGB) is unaffected.
(6) Data at the end of the contract.
- A paid contract ends only the plan; your account continues on the free plan, within its limits, unless you also ask for deletion.
- When you delete your account, we delete your data as described in the privacy notice. You can export it beforehand at any time ("export my data").
§15 Right of withdrawal
As a consumer you have a statutory right of withdrawal. When ordering a paid plan you can ask us to start immediately, before the withdrawal period ends. To do so, you confirm this statement:
"I expressly request that Gravel starts providing the service before the withdrawal period ends. I understand that if I withdraw, I must pay a reasonable amount for the service provided up to that point, and that my right of withdrawal expires once the contract has been fully performed."
Without this statement, the paid service period starts only after the withdrawal period ends; until then you can use the free plan within its limits.
Withdrawal notice (translation)
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract is concluded.
To exercise the right of withdrawal, you must inform us (Victor Gulchenko, Emanuelstraße 27, 80796 München, Germany, email: victor.gulchenko@gmail.com) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
If you requested that the services begin during the withdrawal period, you shall pay us an amount proportionate to what has been provided until you informed us of your withdrawal from this contract, in comparison with the full coverage of the contract.
End of withdrawal notice
Model withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.)

§16 Availability and third-party platforms
(1) We aim for availability of 99% on monthly average, excluding announced maintenance. We announce maintenance 48 hours in advance where possible and schedule it at quiet times.
(2) The Service depends on third-party platforms, in particular:
- messengers: WhatsApp, Telegram, Threema, SMS providers, later Apple Messages for Business
- email and calendar interfaces: Google, Microsoft, Apple
If these providers change their terms or end access, a feature may be unavailable temporarily or permanently. For example, AI assistants' access to WhatsApp currently rests on interim measures of the European Commission. Where possible, we then offer you another channel.
(3) Your rights in case of defects (§18) are unaffected.
§17 Changes to the Service
(1) We develop Gravel further. We may change the Service beyond what is necessary to keep it in conformity with the contract if there is a valid reason, for example:
- adapting to new technology or law
- security
- changes at third-party platforms
- improving features
You incur no additional costs, and we inform you clearly and comprehensibly about the change (§327r(1) BGB).
(2) If a change impairs your access to the Service, or its usability, more than insignificantly, we inform you in advance in text form about the features and timing of the change and about your rights. You can then end the contract free of charge within 30 days of receiving the information, or of the change if it happens later (§327r(2), (3) BGB).
(3) During the contract term we provide the updates, including security updates, that are needed to keep the Service in conformity with the contract (§327f BGB).
§18 Rights in case of defects
The statutory rules on contracts for digital products apply (§§327 ff. BGB).
§19 Liability
(1) We are liable without limitation:
- for intent and gross negligence
- for damage arising from injury to life, body or health
- under the Product Liability Act
- where we have given a guarantee
(2) For slightly negligent breach of an essential contractual obligation, we are liable only for the typical damage foreseeable when the contract was concluded. Essential contractual obligations are those whose fulfilment makes proper performance of the contract possible in the first place, and on whose fulfilment you may regularly rely. For Gravel they include in particular:
- carrying out actions only within your autonomy levels, and after your confirmation where required
- keeping your data confidential and protecting it
(3) Otherwise, liability for slightly negligent damage is excluded.
(4) These limitations also apply in favour of our employees and agents.
(5) Your rights under §§327 ff. BGB are unaffected. Contributory fault (§254 BGB) is taken into account, in particular where you confirmed an action whose content was fully shown to you.
§20 Data protection
How we process personal data is explained in the privacy notice. We do not train AI models on your data.
§21 Changes to these terms
(1) Changes to these terms that affect your contractual rights and obligations take effect only with your express consent. We notify you at least six weeks before the planned effective date, in text form, in the chat and by email, and highlight the changes.
(2) If you do not consent, the contract continues on the previous terms. We may then terminate it with ordinary notice under §14.
(3) Purely editorial changes that do not affect your rights and obligations (for example typos or a new address) are notified to you without requiring consent.
§22 Final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If your habitual residence is in another EU state, you keep the protection of that state's mandatory provisions (Art. 6(2) Rome I Regulation).
(2) Information on consumer dispute resolution is in the imprint.
(3) If a provision of these terms is invalid, the content of the contract is governed by statutory law to that extent (§306 BGB).
